Illinois lawmaker proposes measure to remove state sales tax on diapers

HB5775 05/14/2026 Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers’ Occupation Tax Act. Provides that diapers for use by infants, children, or adults are exempt from the taxes under the Acts. Effective immediately. HB5579 02/06/2026 Creates the Local Referendum Neutrality and Taxpayer Protection Act. Provides that a public body may only expend public funds related to a local referendum for specified purposes. Provides for the designation of an official committee in favor and the official committee opposed to the local referendum. Provides for the preparation of arguments in favor of or in opposition to the local referendum by the committees. Provides that an election authority shall review the arguments and publish the arguments in a voter information package. Sets forth provisions concerning conduct by public employees and public bodies. Amends the State Officials and Employees Ethics Act. Provides that activities intended to influence voter support for or opposition to a referendum or potential referendum, when conducted using public funds, public facilities, or employee compensated time, constitute prohibited political activity. Effective immediately. HB5243 02/05/2026 Amends the Township Code. Provides that tentative budgets for specified road districts shall be subject to a public hearing and public inspection prior to adopting a budget and appropriation ordinance for road purposes. Provides that the township board may adopt all or part of the tentative budget and appropriation ordinance for road purposes and levy the amount determined by the board. Effective immediately. HB4656 01/28/2026 Amends the Counties Code. Removes a provision limiting a special investigator appointed by a State’s Attorney to carrying a firearm only in the performance of the special investigator’s assigned duties. HB4657 01/28/2026 Amends the Unified Code of Corrections concerning executive clemency. Provides that, upon request, the Department of Corrections shall provide disciplinary records of the petitioner to the State’s Attorney of the county in which the conviction had been entered. Provides that any State’s Attorney provided disciplinary records of a petitioner is prohibited from disseminating the disciplinary records or their contents. Provides that the records and the information contained in the records may only be disclosed as part of a response to a petition for clemency or during a related clemency hearing. Provides that upon an application for compassionate release, the Department of Corrections shall provide the State’s Attorney serving the county in which the applying petitioner’s conviction was entered with a copy of the petitioner’s complete disciplinary files and complete medical file and any evaluations, whether by prison medical staff or outside medical providers, which form the basis for the petitioner’s application for compassionate release. Provides that the records shall remain in the exclusive possession of the State’s Attorney and shall not be disclosed other than in hearings on compassionate release or written responses to the petitioner’s compassionate release petition. HB4658 01/28/2026 Amends the Criminal Code of 2012. Provides that violation of an order of protection is a Class 4 felony if the defendant has any prior conviction for violation of a civil no contact order, violation of a stalking no contact order, or any prior conviction under the law of another jurisdiction for an offense that could be charged in the State as violation of a civil no contact order or violation of a stalking no contact order. Provides that violation of a civil no contact order is a Class 4 felony if the defendant has any prior conviction for violation of an order of protection, violation of a civil no contact order, or violation of a stalking no contact order, or any prior conviction under the law of another jurisdiction for an offense that could be charged in the State as a violation of an order of protection, violation of a civil no contact order, or violation of a stalking no contact order. Provides that violation of a stalking no contact order is a Class 4 felony if the defendant has any prior conviction under the Code for a violation of an order of protection, violation of a stalking no contact order, or violation of a civil no contact order, or any prior conviction under the law of another jurisdiction for an offense that could be charged in the State as a violation of an order of protection, violation of a civil no contact order, or violation of a stalking no contact order. HB4351 01/08/2026 Amends the Illinois Vehicle Code. Allows the Secretary of State to issue a special registration plate designated as a retro license plate. Provides that the design and color of the plates shall be a replica of the license plates issued between 1983 and 2001. Provides that there shall be an additional $40 fee for original issuance of a retro license plate and a $27 fee for renewal of a retro license plate. Creates the Theresa Tracy Trot-Illinois CancerCare Foundation Fund. Makes a conforming change in the State Finance Act. Effective January 1, 2027. HB4353 01/08/2026 Amends the Private Detective, Private Alarm, Private Security, Fingerprint Vendor, and Locksmith Act of 2004. Provides that the Private Detective, Private Alarm, Private Security, Fingerprint Vendor, and Locksmith Board shall consist of 12 (rather than 13) members. Removes the requirement that one member of the Board be a licensed private detective or licensed private security contractor who provides canine odor detection services. Provides that a majority of appointed Board members constitutes a quorum. HB4158 10/14/2025 Amends the Illinois Vehicle Code. Prohibits a low-speed electric bicycle from being used on a public roadway by a person without a valid driver’s license. Effective immediately. HB4159 10/14/2025 Amends the Illinois Vehicle Code. Removes every low-speed electric bicycle from the definition of “bicycle”. Effective immediately. HB3391 02/07/2025 Amends the Illinois Vehicle Codes. Provides that, for taxable years 2026 and thereafter, the maximum income limitation for the low-income senior citizens assessment freeze homestead exemption is $75,000 for all qualified property. Effective immediately. HB3237 02/06/2025 Amends the Criminal Code of 2012. Provides that a person is not engaged in conduct that would constitute a felony or a Class A misdemeanor or in a place where the person does not have a right to be if the person is engaged in the activity or in the place due to the person’s status as a trafficking victim. Provides that a person must prove the person’s status as a trafficking victim by clear and convincing evidence. Provides that the person may provide clear and convincing evidence of the person’s status as a trafficking victim through testimony at trial. Defines “trafficking victim” as a person subjected to the practices prohibited by the involuntary servitude, involuntary sexual servitude of a minor, or trafficking in persons statutes. HB1898 01/29/2025 Amends the Illinois Income Tax Act. Creates an income tax deduction for gratuities that are included in the taxpayer’s federal adjusted gross income. Effective immediately. HB1899 01/29/2025 Amends the Illinois Income Tax Act. Creates an income tax deduction for the amount of overtime compensation that is paid to the taxpayer during the taxable year and that is included in the taxpayer’s federal adjusted gross income. Effective immediately. HB1900 01/29/2025 Amends the Illinois Income Tax Act. Creates an income tax credit for caregivers who have uncompensated eligible expenditures in connection with the care of an eligible related person during the taxable year. Provides that “eligible related person” means a person who meets certain age and residency requirements, requires assistance with at least one activity of daily living, and qualifies as a dependent, spouse, parent, or other relation of the primary caregiver or has a close association with the primary caregiver, including as a friend or neighbor. Provides that taxpayers shall apply for the credit to the Department on Aging. Sets forth limitations on the amount of the credit. Effective immediately. HB1901 01/29/2025 Amends the Election Code. Provides that a permanent polling place for early voting must remain open beginning the 15th day before an election through the end of the day before election day during the hours of 8:30 a.m. to 7:00 p.m., or 9:00 a.m. to 7:00 p.m., on weekdays (currently, during the hours of 8:30 a.m. to 4:30 p.m., or 9:00 a.m. to 5:00 p.m., on weekdays). HB1902 01/29/2025 Amends the Animal Welfare Act. Provides that dog breeders must genetically test or have their dogs genetically tested for diseases that cause early death or physical impairments. Provides that if the dog breeder finds that a dog he or she breeds has a genetic defect or mutation that causes early death or physical impairments, the dog breeder must have that dog sterilized. HB1903 01/29/2025 Creates the Human Trafficking Order of Protection Act. Provides that the following persons may bring an action under the Act: (1) a person who is a victim of human trafficking regardless of the relationship between the victim and the trafficker; or (2) a person on behalf of a minor child or an adult who has been the victim of human trafficking. Establishes procedures on how to commence actions for human trafficking, including independently, in conjunction with another civil proceeding, or in conjunction with a delinquency petition or a criminal prosecution. Establishes further procedures in relation to filing fees and dismissal and consolidation. Provides that the Administrative Office of the Illinois Courts may adopt rules to establish a pilot program to allow for electronic filing of petitions for temporary orders of protection and issuance of orders by audio-visual means. Establishes the applicability of the rules of civil procedure including venue, objections, and summons. Provides for specified remedies. HB1904 01/29/2025 Amends the Stalking No Contact Order Act and the Civil No Contact Order Act. Provides that the court shall (rather than may) award the petitioner costs and attorney’s fees if a stalking no contact order is granted. Provides that the court shall award the petitioner costs and attorney’s fees if a civil no contact order is granted. HB1905 01/29/2025 Amends the Use Tax Act, the Retailers’ Occupation Tax Act, and the State Finance Act. Provides for a sales tax holiday on school supplies during the first 7 days of August of each calendar year. Effective immediately. HB1906 01/29/2025 Amends the Property Tax Code. Creates a senior citizens homestead school levy exemption for property that is improved with a permanent structure that is occupied as a primary residence by an applicant who (i) is 65 years of age or older during the taxable year, (ii) has a household income that does not exceed the maximum income limitation, (iii) is liable for paying real property taxes on the property, (iv) is an owner of record of the property or has a legal or equitable interest in the property as evidenced by a written instrument, if no individual residing at the real property is or will be enrolled in a public school. Effective immediately. HB1907 01/29/2025 Amends the Illinois Vehicle Code. Provides that a unit of local government, including a home rule unit, may not enact an ordinance providing for a noise monitoring system upon any portion of its roadways (removing language allowing the City of Chicago to enact an ordinance providing for a noise monitoring system upon any portion of the roadway known as Lake Shore Drive). Makes changes to the definition of “noise monitoring system”.
